Welcome to Whipped Up Bath & Body Co. These Terms and Conditions govern your use of whippedupbathandbody.com, including purchases of our whipped body butter, sugar scrubs, dessert-inspired body care, gifts, wholesale products, and white-label or private-label products.

Throughout these Terms, “Whipped Up,” “we,” “us,” and “our” refer to Whipped Up Bath & Body Co. “You” and “your” refer to website visitors, customers, wholesale buyers, and other users of this website.

By visiting our website, creating an account, submitting information, or placing an order, you agree to these Terms and Conditions, our Privacy Policy, and our Shipping & Returns Policy. If you do not agree, please do not use this website.

1. Eligibility and Website Use

You must be at least the age of majority in your state of residence or have the permission and supervision of a parent or legal guardian to use this website or make a purchase.

You agree to use this website only for lawful purposes. You may not:

• Use the website for fraudulent, deceptive, or unlawful activity.

• Attempt to interfere with the website’s security or operation.

• Upload viruses, malicious code, or harmful material.

• Collect information about other users without permission.

2. Product Information

Whipped Up Bath & Body Co. produces small-batch body care products, including whipped body butter, sugar scrubs, gifts, samples, and seasonal products.

We make reasonable efforts to present accurate product descriptions, ingredients, sizes, colors, photographs, prices, and availability. However, slight differences may occur.

Because our products are prepared in small batches, variations in color, texture, fragrance, swirl pattern, fill appearance, and packaging may occur. Computer and mobile-device screens may also display colors differently. These variations do not necessarily indicate that a product is damaged or defective.

We reserve the right to update product descriptions, ingredients, packaging, prices, sizes, fragrances, availability, and other information at any time.

3. Cosmetic Product Disclaimer

Whipped Up products are cosmetic body care products intended for external use only. They are not food and should not be consumed, even when a fragrance or product is inspired by desserts, bakery treats, candy, ice cream, or soda.

Our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Information on this website is provided for general product and educational purposes and is not medical advice.

Always review the complete ingredient list before use. If you have allergies, sensitive skin, a medical condition, or concerns about an ingredient, consult an appropriate healthcare professional and perform a patch test before broader application.

Stop using a product if irritation or an adverse reaction occurs. Avoid contact with the eyes and keep products out of reach of children and pets.

4. Orders and Acceptance

Submitting an order does not guarantee that it has been accepted. After checkout, you may receive an email confirming that we received your order. An order is accepted when it enters fulfillment or is shipped.

We may refuse, limit, or cancel an order because of:

• Product unavailability

• Pricing or listing errors

• Suspected fraud or unauthorized payment

• Shipping restrictions

• Unusually large quantities

• Violation of these Terms

• An inability to complete a custom request

• Any other lawful business reason

If we cancel a paid order, we will refund the applicable amount to the original payment method.

5. Prices, Payments and Taxes

Prices are shown in U.S. dollars unless otherwise stated. Applicable taxes, shipping charges, and other disclosed costs are calculated at checkout.

Payment must be authorized before an order is produced or fulfilled. Payments are processed by third-party payment providers, and we do not directly store complete payment-card information.

We reserve the right to correct pricing, description, promotion, or availability errors. If an error affects an order you already placed, we will contact you before proceeding or cancel and refund the affected item.

Discount codes and promotions:

• Must be used before their expiration date.

• Cannot be combined unless expressly permitted.

• Have no cash value.

• May exclude certain products or order types.

• May be modified or discontinued as allowed by law.

6. Processing, Shipping and Delivery

Retail orders are generally processed within 3–5 business days, excluding weekends and holidays. Processing may take longer during sales, holidays, launches, or periods of high order volume.

Whipped Up currently ships retail website orders within the United States. Free standard shipping is available on qualifying U.S. orders of $35 or more. Shipping charges for other orders are calculated at checkout.

Carrier delivery dates are estimates and are not guaranteed. Customers are responsible for providing an accurate and complete shipping address.

Complete shipping, tracking, warm-weather, missing-package, and delivery terms are available in our Shipping & Returns Policy, which is incorporated into these Terms.

If we cannot ship within the promised timeframe, we will provide any notice, cancellation option, or refund required by applicable law.

7. Cancellations and Changes

Cancellation or change requests for Shopify website orders must be submitted within 24 hours of purchase. Requests are not guaranteed once production, packaging, or fulfillment has begun.

Orders cannot be canceled after shipment.

Customized, wholesale, private-label, white-label, corporate gift, party-favor, and specially produced orders cannot be canceled once production begins.

Orders placed through Etsy, Faire, or another marketplace are also subject to that marketplace’s applicable cancellation and transaction policies.

8. Returns, Exchanges and Refunds

Because our products are personal care items, we do not accept general returns or exchanges.

Opened or used products cannot be returned. We also do not accept returns based on fragrance preference, normal small-batch variations, or heat-related texture changes when the product remains usable.

If an order arrives damaged, defective, leaking, or incorrect, contact us within seven days of delivery. Include your order number, a description of the problem, and clear photographs of the product and shipping packaging.

After reviewing the request, we may provide an appropriate replacement, refund, or store credit. We may require the product to be returned.

Gift boxes, samples, party favors, clearance products, customized products, wholesale orders, white-label products, private-label products, and specially produced orders are final sale unless they arrive damaged, defective, or incorrect.

9. Warm-Weather Product Changes

Whipped body butter can soften or lose some of its whipped appearance when exposed to heat during shipping or storage.

Customers should monitor tracking and bring packages indoors promptly. If body butter arrives softened, keep the container upright and allow it to firm in a cool indoor location or refrigerator before opening.

A heat-related change in texture, volume, or appearance does not necessarily affect the product’s moisturizing performance. Contact us within seven days if a product arrives leaking, unsealed, damaged, or unusable.

10. Wholesale, White Label and Private Label

Whipped Up Bath & Body Co. offers wholesale, white-label, private-label, corporate-gift, and event-favor services to qualifying customers.

These orders may be subject to separate terms covering:

• Minimum order quantities

• Pricing and payment schedules

• Production timelines

• Label and artwork approval

• Fragrance and packaging selection

• Order changes and cancellations

• Shipping and damage claims

• Regulatory responsibilities

• Resale and brand usage

If separate written terms, an invoice, proposal, marketplace agreement, or wholesale contract applies to an order, those specific terms control in the event of a conflict with these general website Terms.

Wholesale orders placed through Faire are also governed by Faire’s applicable terms and policies.

Unless otherwise agreed in writing, buyers who supply or apply their own labels are responsible for ensuring that their final labels, marketing claims, resale practices, and product presentation comply with applicable laws and marketplace requirements.

11. Reviews, Comments and Submitted Content

If you submit a review, photograph, testimonial, comment, suggestion, or other content, you confirm that:

• You own the content or have permission to submit it.

• The content is accurate and reflects your honest experience.

• It does not violate another person’s privacy or intellectual-property rights.

• It is not unlawful, threatening, abusive, deceptive, or defamatory.

You grant Whipped Up Bath & Body Co. a nonexclusive, royalty-free right to use, reproduce, edit, and display submitted content in connection with our website and marketing, subject to applicable law.

We may remove content that violates these Terms, but we are not obligated to monitor every submission.

12. Intellectual Property

The Whipped Up Bath & Body Co. name, Whipped Up Sweet Shop branding, website copy, product names, collection names, photographs, graphics, logos, packaging designs, and other original content are owned by or licensed to Whipped Up Bath & Body Co.

You may not reproduce, modify, distribute, sell, publish, or commercially use our intellectual property without prior written permission.

Purchasing a product does not transfer ownership of our trademarks, designs, photographs, formulas, website content, or other intellectual property.

Our total liability relating to a particular purchase will not exceed the amount paid for the product giving rise to the claim, except where a different remedy is required by applicable law.

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in effect.

21. No Waiver

A failure to enforce any provision of these Terms does not waive our right to enforce that provision or another provision in the future.
